Abstract:
Since time immemorial, the conflict has been part and parcel of mankind’s existence. Consequently, mankind has delved into exploring a mosaic of mechanisms, tailored to resolve different kinds of conflicts that may emerge following a disagreement. In the recent decade, the litigation approach to conflict management has gained profound popularity since its utility has been intensified by contemporary societies across the world. Kenya as one of the developing countries has not been insulated from the wrath of different conflicts. It has experienced different types of conflicts that mainly stem from but are not limited to perpetual corruption and impunity; continued marginalization and disenfranchisement of different ethnicities; the emotive land issues among others.
